APHA deeply troubled by court ruling to overturn Affordable Care Act

Statement from Georges C. Benjamin, MD, executive director, American Public Health Association

Washington, D.C., December 15, 2018 – "The judge’s decision in Texas v. United States handed down late Friday presents a grave threat to public health.

"The Affordable Care Act is a cornerstone of the U.S. public health system, which has saved countless lives by greatly improving access to health care and making prevention and public health a priority through the Prevention and Public Health Fund.

"By ruling the Affordable Care Act unconstitutional, the decision puts the lives of millions of Americans at serious risk. It eliminates protections for Americans with pre-existing health conditions. It creates enormous personal and financial uncertainty for those with health coverage through the ACA marketplaces and destabilizes the underlying health insurance market for all Americans. It reverses all the progress we’ve made toward a greater focus on prevention.

"The case was politically motivated and wrongly decided on ideological grounds, not firm legal ground. It cannot stand.

"We urge the courts to reject this decision and call upon the administration and Congress to defend the ACA as established law and work to strengthen the life-saving health benefits it provides."
